License Agreement

PLEASE READ THIS AGREEMENT IN ITS ENTIRETY

BY CREATING AN ACCOUNT, YOU ACCEPT THE TERMS AND CONDITIONS STATED BELOW IN A LEGALLY BINDING MANNER.

If you are obtaining the software as defined below on behalf of a company, you represent that you are duly authorized to represent the company and accept the terms and conditions of the agreement on behalf of the company. A binding contract is then formed between TainoSolutions.com and the company in accordance with the terms of this agreement. You personally agree not to commit or encourage any violation of our agreement with the company.

If the company you represent or you (collectively "you") do not agree to the terms and conditions of this agreement, do not create an account.

PROPRIETARY RIGHTS AND CONDITIONS

All rights, titles, and interests,— including, but not limited to, copyright and intellectual property rights in and to the TainoSolutions platform (including all code, interfaces, and underlying technologies) — are owned by TainoSolutions.com.

You may not redistribute, sublicense, reverse engineer, or attempt to access the source code of the platform. Modified or customized versions of the platform may not be resold, rebranded, or offered as a service without prior written consent from TainoSolutions.com.

DISCLAIMER OF WARRANTIES

To the extent allowed by all applicable law, this software is provided to you "as is" without warranties or conditions of any kind, whether oral or written, express or implied. TainoSolutions.com specifically disclaims any implied warranties or conditions of merchantability, satisfactory quality, non-infringement and fitness for a particular purpose.

LIMITATION OF LIABILITY

Except to the extent prohibited by all applicable law, in no event will TainoSolutions.com, or its employees or officers be liable for direct, special, incidental, consequential or other damages (including lost profit, lost data, or downtime costs), arising out of the use, inability to use, or the results of use of the software, whether based in warranty, contract, tort or other legal theory, and whether or not advised of the possibility of such damages. Your use of the software is entirely at your own risk.

SECURITY

TainoSolutions is hosted in a secure cloud environment with industry-standard firewall protection, encrypted connections (SSL/TLS), and robust access controls to prevent unauthorized access.

Each user is issued a unique login and session token, and all sessions are encrypted. We do not store passwords or sensitive data in cookies, and all access is governed by role-based permissions defined by the agency administrator.

It is your responsibility to ensure that only authorized personnel access your agency account. TainoSolutions is not responsible for account misuse resulting from insufficient internal access controls.

GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes or claims arising under this agreement shall be subject to the exclusive jurisdiction of the state or federal courts located in Broward County, Florida.

SMS TERMS & CONDITIONS

Note: These SMS terms apply only to messages sent directly by Taino Solutions. Agencies using the Taino platform to communicate with their own customers are responsible for establishing and maintaining their own SMS opt-in policies and disclosures in compliance with applicable laws.

1. SMS Consent Communication:
Phone numbers provided through SMS opt-in forms will not be shared with third parties or affiliated companies for marketing purposes.

2. Types of SMS Communications:
By consenting to receive SMS messages from Taino Solutions, users may receive text messages related to the following:

  • Support follow-ups
  • Sales inquiries and demo scheduling
  • Account setup or usage instructions
Example: “Hi, thanks for reaching out to Taino Solutions! Let us know if you’d like help getting started. Reply STOP to opt out at any time.”

3. Message Frequency:
Message frequency may vary depending on your interactions, but will not exceed 5 messages per week.

4. Messaging Fees:
Standard message and data rates may apply, depending on your mobile carrier. These rates are your responsibility.

5. Opt-In Method:
Users can opt in to receive SMS messages by checking the SMS consent box in our website contact form at https://www.tainosolutions.com/#contact-us-section.

6. Opt-Out Method:
To stop receiving messages, reply with the word “STOP” to any SMS from us. You can also contact us directly to be removed from our messaging list.

7. Help:
To get help, reply “HELP” to any SMS or visit our contact form at https://www.tainosolutions.com/#contact-us-section.

8. Disclosures:
Message and data rates may apply. Opt out any time by replying “STOP.” For support, text “HELP” or visit our Privacy Policy and Terms and Conditions. Message frequency may vary.

PRIVACY STATEMENT

TainoSolutions does not sell, share, or disclose any personal data or client information stored in the system. All data entered by the user remains the exclusive property of the agency or organization. TainoSolutions acts only as a processor, and does not use customer data for marketing, analytics, or any third-party services without explicit consent.

AMENDMENTS

TainoSolutions reserves the right to modify or update this agreement at any time. If material changes are made, we will provide advance notice either via email or through a prominent notice within the platform. Continued use of the platform after such changes constitutes your acceptance of the updated terms.
